Approved Site Plan - The subject property shall be used <br /> only for multiple family development per the approved site plan <br /> and the requirements of the Mitigated Determination of <br /> Nonsignificance 1135-89. Minotx evisions to the site plan <br /> e <br /> which result in a lower intensitydevelopment may be approved <br /> by the Planning and Community Development Director. However, <br /> in no case shall minor revisions result in an increased impact <br /> on adjacent properties or environmentally sensitive areas. <br /> 2. Building Height -The building height shall be limited to <br /> 35 feet above the existing grade of the site. The detailed <br /> plans submitted for building permits must show calculations for <br /> he base elevation and building height. <br /> 3. Prior to issuance of any permits, the Applicant must submit <br /> a geotechnical engineering report which shows how impacts to <br /> adjacent properties can be eliminated or minimized. <br /> 4. Completion o4 Construction Upon completion of the <br /> improvements In accordance with the terms specified herein, a <br /> ordinance nsistent with this Resolution shall be <br /> presented to the city Council for their consideration and <br /> approval. <br /> 5. Use of Property Inconsistent with this Resolution-Any use /-\ <br /> of the subject property inconsistent with the terms of this <br /> Resolution,either before, during, or after construction shall <br /> be grounds for revocation of this Resolution by the City <br /> uncil and hall also be considered a violation of the Zoning <br /> Code and subject to the violation and enforcement provisions <br /> thereof. <br /> 6. Expiration of this Approval-If all improvements required <br /> herein are not completed in full compliance with the terms of <br /> this Resolution within five (5) years of the date of City <br /> Council approval,this resolution shall be come <br /> null and void. <br /> In the vent that this Pe on becomes null and void, <br /> he subject of the site shall be subject to the requirements of <br /> the 0-3 PROzone <br /> and all regulations, including environmental <br /> regulations,in effect at the time of application for permits. <br /> 7. This performance agreement shall be filed in the records of <br /> the Snohomish CountyAuditor for the purpose of subjecting the <br /> propertyto the restrictions, conditions, and limitations <br /> set et forth which are intended and shall have the force <br /> and effect of deed restrictions and shall be deemed to be <br /> covenants running with the land for the periods described and <br /> binding upon the owners,their successors,tenants,and assigns. <br /> 0 <br />• <br />
