WHEREAS, Royal Flush Partnership represented by Marianne <br /> Christian-Griffith,has filed an application to rezone property <br /> located south of SR 526,north of Cseino Road,east of Hardeson <br /> Road and west of Upper Ridge Road from R-3 PRO (Multi-Family <br /> Medium Density Planned Residential Development) to R-3 <br /> (Multi-Family Medium Density Residential) far the purpose of <br /> developing a 36 unit apartment complex;and <br /> WHEREAS, the Hearing Examiner after public hearing, review of <br /> the Revised Mitigated Determination of Non-Significance (MONS) <br /> and consideration of the recommendation of the Planning <br />• Department, adopted certain Findings and did recommend to the <br /> City Council that the proposed rezone be approved pursuant to <br />• the provisions of Section 41.160.0.7 of Ordinance 1671-85, as <br />• amended, and subject to the specific conditions set forth in <br />• said recommendation;and <br /> WHEREAS, the R-3 zone includes a height limitation of 35 feet <br />• above the base elevation of the site;and up to 30 feet of fill <br /> was placed on the subject site during the construction of <br /> SR-526 and Casino Road; and the Hearing Examiner granted a <br /> variance to allow the height of the proposed buildings to be 35 <br /> re.above the existing grade of the site based upon review of <br /> the proposed development site plan;and <br /> (—) <br />
