By awarding this bid to <br /> the low bidder, City Council is knowingly waiving a minor <br /> irregularity that the Legal Department has indicated does not <br /> constitute a material irregularity. The bid documents state <br /> that the entire bid and contract documents in.the Original <br /> binder must be submitted et the bid opening. State Roofing <br /> removed and submitted only the bid documents. <br /> The Legal Department has indicated that the variance would have <br /> to give the bidder a substantial advantage or benefit not <br /> enjoyed by other bidders to warrant rejection of the low bid. <br /> It was <br /> a deemed that this irregularity did not. Also, the bid <br /> fromCRJ Roofing was delivered to the Police Department on <br /> April 30, at 1:10 p.m., in time for the bid opening; however, <br /> was received by the Park Department in the city inter-office <br /> mail on May 1. This was also deemed a <br /> nr irregularity and <br /> does not effect the award Of the low bid to State Roofing. <br />
