274 July 22,1992 Both Mayor Kinch end Councilman Overstreetm ended Planning Department personnel for their work on thisresolution and agreement. RESOLUTION-U.S.WEST NEW VECTOR'S CELLULAR TOWER President Gipson handed the gavel to Vice President Anderson. President Gipson and councilman Moser departed from the Council Chamber as they had not been in attendance for the previous hearings relating to this topic. Councilman Diamond related that he had not heard the tape of the previous vote on this resolution that was tied 2-2. Assistant City Attorney dim Iles said this was not a problem as Councilman Diamond had been in attendance atthe hearings. Moved by councilman Diamond, seconded by Councilman Overstreet to adopt Resolution No. 3650 containing findings, conclusions, and a decision regarding the appeal of the SEPI determination for U.S. West New Vector's proposed cellular tower located at Evergreen Cemetery as follows: WHEREAS, the City Council finds that on December 17, 1991, the City received aC_ ompleted application for a Special Property permit'frdd cUS West NewVector Group, Inc. for new cellular communications tower and antenna facility;end WHEREAS, the City Council finds that as a result of a review under SEPA, a Mitigated Determination of Non-(tgnificance (MONS)was issued by the Responsible Official on April 2, 1992; and WHEREAS, the,a0ity..Council finds that an appeal letter was received from Mark Stowe on behalf of the Lowell Civic Association;and WHEREAS, the City Council finds that after due notice an appeal hearing sat•held before-the City Counoil commending on June'3, 1992;and WHEREAS, the City Council finds that following review of the record of the appeal proceedings, consideration of the • testimony and argument of the parties, and after due deliberation of the issues, Council makes its decision in accordance with'the piovisions of this resolution.
