August 16,2000 Moved by Couvcilmemba Warnock,seconded by Comwibnember Overstreet that this is declmd to be the third and final railing of Council Bill No.0008-37. Peter Camp,Assistant City Attorney,stated that he had been asked if the City could require the franchisee to have a buildout schedule or performance requirements in the franchise agreement.The answer is no,Federal law won't allow it. C000e,member Gipson questioned whether Black Rock Cable has the right to consuuct Wee when and wherever they wane Peter Camp,Legal,stand that they are required to get permits for the actual planarian of their lines. John Karnes,Black Rock Cable,gave an overview of an open video system.Be stated that it ie no different than a able or phone system in a physical areae.They only differ is a regulatory sense.Congress has removed approximately 90 percent of the cable regulations from the open video system operators to stimulate coopetition in the video make. Councilmanbee Simpson questioned whether Black Root Cable operates in other cities. John Kehres stated that they now have franchises in Bellinghw,Whincm0 County,Lynnwood,and Mountlake Terrace.He divulged that Black Rock Cable has entered into apurchase and sale agreement with Senn Innovations. Peter Camp,Legal,commented that there are change of control provisions in the franchise ordinance and them can be no change of control without the City Comwil'e approval.
