November 15,1000 <br /> Map amendment and rezone applications initiated by private property owners; <br /> and <br /> WHEREAS,the Everett Zoning Code provides a mechanism by which the City <br /> and property owner may enter into a"performance agreement"wherein the <br /> proponent of a rezone agrees to develop property according to the terns of the <br /> agreement before the rezone in finalized by the City;and <br /> WHEREAS,the City Council has approved the application to amend the Ian <br /> Use Map;and <br /> WHEREAS,the Ordinance amending the land use map requires that the zoning <br /> requested to implement the changed land use daignntioa be established through <br /> a Resolution of Intent to Rezone which includes certain conditions and <br /> limitations agreed to by the applicant and the City:and <br /> WHEREAS, William Scrupps has filed an application to change the <br /> Comprehemive Plan designation from 1.6(Multiple Family)to 4.4(Mixed Use <br /> Commercial Multi-Family)and rezone the same area from R-3(Multiple Family <br /> Medium Deesity)to C-I(General Commercial),for the purpose of construction <br /> of a self serve mini storage facility;and <br /> WHEREAS,the C-t zone allows a wide range of commercial uses which could <br /> have a detrimental impact on the residential areas located to the north and west; <br /> and <br /> WHEREAS,the applicant has agreed to meet the same conditions placed on the <br /> Earl Rumness property to the south for a similar project;and <br /> WHEREAS,the Everett Planning Commission,after a workshop and public <br /> hearing and in consideration of the recommendations of the Planning <br /> Department,did adopt certain findings and did recommend,by Resolution,to <br /> the City Council that the proposed Comprehensive Plan map change and rezone <br /> be approval subject to the specific conditions set forth in said Resolution;and <br /> Resolution No.4976 in its entirety is Ned In the City Clerk's office. <br /> 528 <br />
