lune 20,2001 <br /> in the Everett City Council Chambers,as the time,date and place of the final <br /> aauument wnfirnnation hearing forthe Evergreen Way Lm No.737. <br /> President Simpson invited public comment. <br /> Allan Gitf Public Works,gave a brief background of meal Improvement <br /> District No.737.He stated that the City Council approved a design plan for <br /> Evergreen Way in 1977 which included these travel lanes in each direction,a <br /> center tum lane curbs,gutters and sidewalks.Seven previous local improvement <br /> districts have been funded far sections of this project from 47.Street to 112. <br /> Street. <br /> Allan stated that the City Council approved the formation of Evergreen Way Lm <br /> No.737 on December 8,1999.Shortly thereafter,while in the design process,the <br /> City learned that the Washington State Department of Transportation had <br /> promulgated an administrative rule(WAC)which states that Clare IP highways <br /> which curt'over25,000 daily tops,must have access controls.This rule prevents <br /> the City's original design,which was brought before the City Council and <br /> preperly owners,hom being built The City is now requited to place median <br /> islands within the center of the highway in various locations as a safety measure <br /> which will restrict some left mm movement <br /> Allan Giffen stated that several of the business owners along Evergreen Way are <br /> opposed to the project if it requires medians.The purpose for bringing this item <br /> before the City Council tonight is to sank a derision regarding the Council's <br /> preference of the due.proposed alternatives which will be dinoasd. <br /> CounciMember Gipson questioned whether the project could be grandfathered in <br /> to void the median requirement.Allan Gifien stated that the administrative rule <br /> was promulgated in 1999,but City staff was not aware of it until after the LI) <br /> was formed. <br /> Councilmember Overstreet questioned haw the City Council's preference <br /> regarding this item would be obtained.Allen stated that staff's recommendation <br /> would be to adopt the proposed resolution setting the hearing on July 11,2001 to <br /> confirm the final assessments for the full project from 112.Sheet to Airport <br /> Road. He remarked that normally the project is built end the costs are <br /> accumulated before the LID is closed.In this case,staff would like to cap the <br />
