July 11,2001 <br /> WHEREAS,the Evoot City Council finds: <br /> I.The Everett Planning Commission held a wodrshop and public hearing on <br /> the proposed Planned Development Overlay Inc the Arnold Hohmann <br /> property on Febmary6,2001 and March 6,2001 respectively;and <br /> 2.The Evervm Planning Commission did recommend approval of a rezone of <br /> the Hofmann property firm R-2 to 13-2 subject to the coalition that the <br /> residential portion of the property remain under R-2 zone regulations;and <br /> WHEREAS, <br /> 1.The City Council held a public hearing to consider the Hohnenn proposal <br /> an lune 27,2001;and <br /> WHEREAS,the City Council finds that: <br /> I.The applicant,Arnold Hafoanv,owns the 9,000 square foot property <br /> located at the southwest corner of 19.Sheet at McDougall in Everett,as <br /> depicted in Exhibit"A";and <br /> 2.The B-2 zone regulations could lead to conversion of the residence on the <br /> site to non residential use if applied to the entire site;and <br /> 3.Input by the Plamtiug Commission and the affected neighborhood group <br /> indicate a dear to keep the residence on the property,and the portion of <br /> the site historically dedicated to it,under the present residential use;and <br /> 6.A SEPA Mitigated Determination of Non-Significance on this rezone <br /> application was issued February 27,2001;and <br /> 5.Mr.Hofinarm desires De change in zonivg from R-2 to B-2 in order to <br /> make the current legal non conforming business use of the property <br /> consistent with the zoom and <br /> 6.The City desires to change the zone and associated regulations as they <br /> apply only to the historic business use of the property,and Rather that the <br />
