August 1,2001 <br /> acquired at public expense,then the compensation provided shall be the Poll <br /> appraised value of the area so vacate. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> Ordinances vacating any shut,alley or any portion thereof pursuant to the <br /> provisions of Chapter 35.79 RCW shall protide that the ordinance shall not <br /> become effective until the owners of the property abutting upon the shat,alley or <br /> any portion thereof so vacated,shall pay to the City one-half the appraised value <br /> of the area so vacated.Provided,if the sheet or alley has been part of dedicatrd <br /> public right-of-way for twenty-five years or more,Wen Pm compensation shall be <br /> in an amount that dos not exceed the full appraised value of the area vacated. <br /> One-half of the revenue received as compensation for the area vacated must be <br /> dedicated to the acquisition,improvement,development and related maintenance <br /> of public open space or nensporlation capital prgwm within the City. <br /> Section 2:The provisions of this Rmolu5on shall apply to all completed vacation <br /> applications filed on or after August 1,2001. ,3 <br /> Councilmembac Warnock had questions regarding the dedication of the revenue <br /> aimed as compensation for the vacation.
