June 15,2005 <br /> Roll was called with all council members voting yes except Council <br /> Member Batlike who was excused. <br /> Motion canied. <br /> RESOLUTION—BUSINESS IMPROVEMENT AREA <br /> Moved by Council Member Olson,seconded by Council Member <br /> Overstreet to adopt Resolution No.5539 initiating and expressing <br /> intent to disestablish the existing downtown Business Improvement <br /> Area(Bid),establishing a new CIA,a budget and assessments and <br /> setting a public hearing for June 29,2005 at 8:30 a.m. <br /> Roll was called with all council members voting yes except Council <br /> Member Hatioe who was excused. <br /> Motion carried. <br /> PUBLIC HEARING—COUNCIL BILL NO.0505-16 <br /> President Krell opened a public hearing regarding Council Bill No.0505- <br /> 16,a proposed ordinance amending Zoning Code Ordinance No.1871- <br /> /39,as amended(EMC Title 19),relating to the location 01 04211 retail <br /> business uses. <br /> Allan Wien,Planning Director,gave a brief history of the proposed <br /> ordinance. He stated that the City Council referred the matter to the <br /> Planning Commission in order to allow them to consider establishing land <br /> usa regulations for adult retail uses The Planning Commission held <br /> public hearings and considered a large volume of information from various <br /> other cities Induding Spokane. Allan discussed recent court rulings <br /> regarding adult retail businesses.He stated that in order to establish land <br /> use regulations on adult retail businesses,City Council must first find that <br /> there are secondary adverse impacts associated with such businesses. <br /> The Planning Commission determined,based on the studies provided and <br /> 173 <br />
