July 20,2005 <br /> Council Member Olson questioned whether there are other B.2 lots on <br /> Terrace Drive. <br /> Allan Gillen,Planning Director,stated that Safeway,which is a block or so <br /> north,is zoned B-2. <br /> Council Member Olson questioned what would happen if the City decided <br /> not to change either the Comprehensive Plan designation or the zoning? <br /> Allan Differ stated the Growth Management Act requires that the City's <br /> Zoning and Comprehensive Plans are consistent and that there are <br /> consequences for being out of compliance. <br /> Council Member Olson questioned whether there would be consequences <br /> of actions by the property owner lithe area were down zoned. <br /> Jim Iles,City Attorney,stated that the area could be down zoned as long <br /> as the owners are allowed reasonable use of their property. <br /> Council Member Nielsen questioned whether the law prohibits a lot from <br /> bearing two different zoning designations. <br /> Allan Giffen stated that the Comprehensive Plan and the Zoning Code <br /> • <br /> suggest that split zoning is nota good practice. <br /> Council Member Krell questioned whether the two lots could have <br /> different Comprehensive Plan designations. <br /> Allan Offen stated that they could. <br /> Council Member Stonecipher questioned whether changing the R.1 to 5.2 <br /> would seta precedent for property owners to the north. <br /> Allan stated that it would only be possible If the property owners were to <br /> combine so that the application of a commercial land use designation to <br /> properties north of the Legowik property would be combined with the <br /> ownerships to the south so there was a single integrated development. <br /> 234 <br />
