March 1,2006 <br /> RESOLUTION—PARKING RATES/EVERPARK GARAGE <br /> Moved by Council Member Overstreet,seconded by Council Member <br /> Nielsen to adopt Resolution No.5738 establishing rates for public <br /> parking at Everpark Garage. <br /> Roll was called with all council members voting yes. <br /> Motion carried. <br /> PUBLIC HEARING—AMENDMENT/JOE ZLAB REZONE <br /> DEVELOPMENT <br /> President Stonecipher opened a public hearing continued from the <br /> February 22,2006 council meeting regarding a proposed resolution <br /> authorizing the Mayor to execute an amendment to the Joe Gab Rezone <br /> Development Agreement. She stated that todeys public hearing is <br /> considered a quasi-judicial matter. Therefore,it is important that the <br /> Ciys proceedings are not only fail in fact but fair in appearance. She <br /> questioned whether any council member knows of any conflict of interest <br /> that she or he might have with the matter before us. Council Member <br /> Roberts stated that although he was not in attendance at the February 22, <br /> 2006 council meeting,he had reviewed the tapes of the hearing and the <br /> public record. Council Member Stonecipher questioned whether any <br /> member of the public has any objection to any council member's <br /> participation in this matter.There was no response. <br /> Council Member Overstreet left the council chambers. <br /> Allan Gillen,Planning,stated that additional materials have been <br /> submitted In the past week to the City Council;correspondence from the <br /> Snohomish County-Camano Association of Realtors,an e-mail from Silver <br /> State Mortgage,and additional correspondence and drawings horn Mr. <br /> Zlab. <br /> Joe Zlab,3425 Norton,gave a brief overview of the proposed changes to <br /> the project. <br /> 50 <br />
