March 18,2008 <br /> Roll was called with all council members eating yes except Council <br /> Member Olson who was excused. <br /> Motion carred. • <br /> AGREEMENT—RIVERSIDE STORMWATER MANAGEMENT <br /> Moved by Council Member Hatloe,seconded by Council Member Affholter <br /> to authorize the Mayor to sign the Riverside Stormwater Management <br /> agreement with Kimberly-Clark Worldwide,Inc.requiring each party to <br /> maintain their portion of the drainage system on the site. <br /> Roll was called with all council members voting yes except Council <br /> Member Olson who was excused. <br /> Motion carried. <br /> BID PROTEST—EVERETT ANIMAL SHELTER <br /> President Nielsen stated that a decision of the bid protest and award of <br /> the construction of the Everett animal shelter contract would be decided at <br /> this time.There Ise bid protest.He specified the procedure that would <br /> be followed.1)a presentation by city attorney's office;2)an opportunity <br /> to speak by the protester and any other interested parties(either the party <br /> may speak on their own behalf or the party's representative may speak <br /> but only one or the other);3)city council will determine the issue on its <br /> merits. <br /> Bruce Jones,City Attorney's Office,explained that the bid protest <br /> materials am in the council's packet as well a summary that was prepared <br /> and has been provided to the city council members. The summary <br /> indicates that the low bidder was Allied Construction Associates with a bid <br /> of 03,320,000 and the next low bidder was Powell Construction Company <br /> with a bid of$3,330,000.00.
