March 4,2009 <br /> COUNCIL BILL NO.0902-02 <br /> THIRD AND FINAL READING: <br /> AN ORDINANCE amending Section 3(0)of Chapter 5 of <br /> Ordinance No. 2530-01 (EMC 15.20.110), eztending the <br /> effective palled for Land Use Permits issued under Review <br /> Process II and III. <br /> Moved by Council Member Gipson,seconded by Council Member <br /> Affholter.to adopt the revised proposed ordinance and that this is <br /> declared to be the third and final reading of Council Bill No.0902-02. <br /> Allan Gillen,Planning.stated that the ordinance is intended to allow more <br /> time for projects that have been approved in the recent past under the <br /> land use process but because of current economic conditions.are unable <br /> to obtain financing and permits at the present time.Giffen noted that the <br /> ordinance proposed at the first and second reading did not include a <br /> sunset provision and has been revised. He then gave an overview of <br /> suggested revisions to the proposed ordinance. <br /> Council Member Gipson questioned whether the time extension will allow <br /> projects to go beyond 2011.Glffen responded that there could be up to <br /> two twelve month extensions granted for a project,and depending when <br /> those extensions are granted,it Is possible that a project would go slightly <br /> past 2011. <br /> Council Member Nielsen noted a conflict In the ordinance language. <br /> Jim Iles,City Attorney,stated that there does appear to be a gap in the <br /> language and asked to hear Council Member Nielsen's proposed <br /> language. <br /> Moved by Council Member Nielson,seconded by Council Member <br /> Roberts to amend the proposed revised ordinance as presented so <br /> that the paragraph that starts with "in Lieu of the above <br /> provisions....",would instead read"With respect to a project for <br /> 58 <br />
