February 17,2010 <br /> PUBLIC HEARING—COUNCIL BILL NO.1001-04 <br /> Council President Roberts opened a public hearing regarding Council Bill <br /> No.1001-04,a proposed ordinance establishing an interim regulation to <br /> allow the creation of zero-lot-line fee simple lots. <br /> Allan Gillen,Planning,stated that the proposed ordinance would apply <br /> only to existing townhouse developments with three or more dwelling <br /> units.He remarked that due to the tightening of credit markets,existing <br /> townhouse developments that were built to be sold as condominiums <br /> cannot be sold.Lenders will lend money if the individual townhouse units <br /> are allowed to be subdivided and placed on their own lot.The proposed <br /> ordinance would change the minimum lot area,lot width and lot depth <br /> standard so that the units can be subdivided which would satisfy the <br /> lenders.He stated that the Planning Commission recommends approval. <br /> Coundl President Roberts invited public comment. <br /> David Mascarenas, Everett,spoke in opposition to the proposed <br /> ordinance. <br /> Dale Packard,Edmonds,spoke in support of the proposed ordinance.- <br /> Annie Lyman,Everett,expressed concem regarding whether there would <br /> be any controls such as a homeowners association and protection from <br /> covenants if the structures are sold to individual buyers. <br /> Joe Jackson stated that the homeowners association will not change.He <br /> remarked that the same restric0ons,covenants and codes will apply. <br /> Moved by Council Member Stonecipher,seconded by Council <br /> Member Affholter to close the public hearing. <br /> Roll was <br /> called with all council members voting yes except Coundl <br /> MemberGipson who was excused. <br /> Motion carried. <br /> 50 <br />
