March 3,2010 <br /> AGREEMENT—BEG UTILITY TAX REFUND <br /> Moved by Council Member Nielsen,seconded by Council Member <br /> Gipson to authorize the Mayor to sign a joint defense agreement with <br /> Ogden Murphy Wallace,PLLC regarding a B&O Utility Tax refund in <br /> the form substantially provided. <br /> Roll was called with all council members voting yes except Council <br /> Members Roberts who was excused. <br /> Motion carried. <br /> AGREEMENT AMENDED—OTT DRYWALL SITE CLEANUP <br /> Moved by Council Member Gipson,seconded by Council Member <br /> Moore to authorize the Mayor to sign Amendment No.2 to the <br /> professional services agreement between the city of Everett and <br /> HWA Geobciences,Inc.for cleanup of the former GTS Drywall site in <br /> the amount of$131,868.00. <br /> Roll was called with all council members voting yes except Council <br /> Members Roberts who was excused. <br /> Motion carried. <br /> CHANGE ORDER—2010 BIOSOLIDS REMOVAL <br /> Moved by Council Member Affholter,seconded by Council Member <br /> Gipson to authorize the Meyer to sign Change Order No.1 with <br /> American Process Group,Inc.for the 2010 Biosolids Removal <br /> Project in the amount of$(101,640.00). <br /> Council Member Nielsen questioned why the biosolids were not suitable <br /> for use. Dave Davis,Public Works,responded that analytical results <br /> show that PCB levels were too high for land application but that the <br /> 80 <br />
