June 15,2011 <br /> President Affholter acknowledged for the record that comments had been <br /> received via email from Alyssa Olsen,Clay Wertheimer,Reid ShocAey, <br /> and William and Renee Ouistorf. <br /> At President Affholter's request Deputy Attorney Hall advised that the <br /> standard for vacation had been met. <br /> Moved by Council Member Roberts,seconded by Council Member <br /> Magee,to close the public hearing. <br /> Roll was called with all council members voting yes. <br /> Motion carried. <br /> VACATION <br /> Moved by Council Member Hadoe,seconded by Council Member <br /> Moore,to approve the proposed vacation of that portion of the <br /> east/west alley abutting Lot 11,Replat of Block 718,Plat of Everett, <br /> and direct staff to prepare an ordinance subject to the conditions as <br /> contained In the staff report <br /> Moved by Council Member Nielsen,seconded by Council Member <br /> Roberts,to amend the motion ayes to approve the proposed <br /> vacation,and direct staff to prepare an ordinance subject either to <br /> the agreement of the parties onto the City's acquisition of the same <br /> amount of footage as it would vacate. <br /> Roll was called with all council members voting yes except Council <br /> Members Moore,Hatt.,Gipson and Affholter who voted no. <br /> Motion tailed. <br /> Roll was called on the main motion with all council members voting yes <br /> except Council Members Nielsen,Roberts and Stonecipher who voted no. <br /> Motion carried. <br /> 177 <br />
