(•} <br /> July 20,2011 <br /> cannabis,establishing interim zoning regulations,and declaring an <br /> emergency to exist and Council Bill No.1107-24,a proposed emergency <br /> ordinance relating to medical cannabis,declaring an emergency to exist, <br /> and declaring a moratorium upon the acceptance of applications. <br /> Ramsey Ramerman,Legal,stated that we am here to discuss collective <br /> gardens for medical cannabis.He remarked that in two days Ems there is <br /> going to be a new land use authorized in Washington State and the city <br /> needs to address the potential public safety and health concerns related <br /> to that use. The city has also leamed of a coordinated effort to exploit <br /> potential ambiguities in the law to allow industrial size grow operations. <br /> He discussed E2SSB 5073 which authorizes collective gardens but gives <br /> the city the authority to regulate those gardens. He stated that the <br /> proposed interim zoning ordinance would limk collective gardens to the <br /> city's Agriculture(A-1)Zone,allow one garden per lot,prohibit them from <br /> being 1000 feet from a school or church and will require the Planning <br /> Director's approval before any garden Is started.The second proposed <br /> ordinance declares a moratorium under the Growth Management Act on <br /> any authorization of these collective gardens. <br /> President Af hotter stated that for the record the city council has received <br /> written comments from Britten Bums and Nena Nyland. <br /> President Amhalter invited public comment. <br /> Craig Simpson,Everett;Clint Foley,Stanwood;Jeremy Kelsey,Everett; <br /> Stephen Schaeffer,Everett;Philip Seedy,Seattle,Washington Cannabis <br /> Association; Dan Aldano, Snohomish; Sean Green, Everett; Jose <br /> Rodriquie,Everett;Marcus Cravens,Lake Stovens;Graham Wendinger, <br /> Everett;Christina Heinz,Everett;John Rappins,Mukikeo;and David <br /> Haamager,Everett;spoke in opposition to the proposed ordinances. <br /> Moved by Council Member Moore,seconded by Council Member <br /> Hattie to close the public hearing. <br /> 208 <br /> • <br />
