WASHINGTON"' EVERETT CITY OF EVERETT, WASHINGTON CONTRACT THIS CONTRACT is made and entered into this 4 day ofeW 2020, by and between the City of Everett, Washington, a municipal corporation existing under the laws of the State of Washington, hereinafter called the "City", and All Around Fence Company, Inc, a corporation, hereinafter called the "Contractor." In consideration of the sums to be paid to it by the City, Contractor hereby covenants and agrees to furnish all labor, tools, materials, equipment, and supplies required to build and construct in a workmanlike manner the work, improvements, and appurtenances in accordance with the Specifications and Plans entitled: CHAIN-LINK FENCE INSTALLATION VARIOUS CITY LOCATIONS The following documents ("Contract Documents") are incorporated by reference and are hereby made a part of this Contract: A. Invitation for Bid #2020-058 B. Information for Contractors such as questions and answers C. General and Special Conditions D. Technical Specifications and Contract Drawings E. Change Orders (if any) F. Addenda G. Bid Response submitted by the Contractor as to those items and/or alternatives accepted by the City (Conformed copy dated July 21, 2020) H. Payment and Performance Bond I. All provisions required by law whether here inserted or not J. Project Plans and Drawings K. Supplemental Drawings L. Permits M. All provisions required by law whether set forth and reproduced herein or not The work shall be physically complete in all respects within forty-five (45) calendar days from the date of issuance of the Notice to Proceed. The parties agree the City will suffer damage and be put to additional expense in the event that the Contractor does not complete the work in all respects and have it ready for use by the physical completion date stated. The amount of this contract is ($99,113.82) and is based on the quote submitted by the Contractor dated July 21, 2020. The basis for final payment will be the actual amount of work performed according to the Contract Documents and payments, whether partial or final, shall be made as specified therein. If, and to the extent, payment (in whole or in part) is based upon unit prices multiplied by quantities of work actually performed, the total amount paid to the Contractor may be less than Contract amount stated herein and the Contractor agrees to execute one or more change orders in such event.
