ORDINANCE NO. 3920_ AN ORDINANCE providing for the improvement of: SEAHURST AVENUE from its intersection with Olympic Boulevard to the easterly end of Madrona Avenue and Madrona Avenue from Seahurst Avenue to its westerly intersection with Mukilteo Blvd. lby the construction of a 6" cast iron water main together with litwo (2) fire hydrants and necessary appurtenances and doing such ;other work as may be necessary therewith to make a complete improve Ient, all in accordance with plans to be prepared by the City ngineer, and providing that the City of Everett shall pay a i ortion of the cost of said improvement creating a local improvemen. idistrict, creating a local improvement district fund therefor; Land providing for the payment of a portion of said improvement by ,special assessments on the property in said district under the ijmode of payment by bonds . r WHEREAS, there has been heretofore filed with the City ;!Council of the City of Everett, a majority petition of the propertyl !owners petitioning for said improvement, and upon examination there l of, the said City Council has found the things set forth therein ;to be true, and WHEREAS, the petition has been duly deferred to the ;;Commissioner of Public Works to be examined by said Commissioner ;and the City Engineer, and the City Commissioner of Public Works `has filed with the City Council all data and information required Thy law. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: ' Section 1: That an improvement be made of Seahurst Ave . :from its intersection with Olympic Boulevard to the easterly end of ,Madrona Avenue and Madrona Avenue from Seahurst Avenue to its 's .westerly intersection with Mukilteo Blvd. by the construction of a 6" cast iron water main together with two (2) fire hydrants and ' necessary appurtenances and doing such other work as may be neces- ,sary therewith to make a complete improvement, in accordance with ';plans to be prepared by the City Engineer, which plans and ; specifications are hereby approved and adopted. ; i Section 2 : That the cost and expense of such improvement shall be borne by and be assessed against the property included ;in the assessment district herein created, in accordance with the zone and termini method of spreading assessments, except that the City of Everett shall pay the costs and expenses of the 'installation of a 4" cast iron water main in such places as said 6" cast iron water main is installed, and shall replace an exist- ' ing 2" galvanized iron main. The City of Everett shall not be . liable in any manner for any remaining portion of the cost and expenses of such improvement, except as above provided, and except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto. Section 3: That there is hereby established a Local Improvement District No. 670 , which district shall include the following described property located in Everett, Snohomish County, Washington, to-wit:
