LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the "License"), between the City of Everett as Grantor (the <br /> "City") and Washington State Food Truck Association, LLC and its authorized members, <br /> as the Grantee ("Grantee"), for use of City owned property. <br /> RECITALS <br /> A. Grantee desires to utilize property owned by the City for mobile food <br /> vending ("food truck") services. <br /> B. The City is willing to grant Grantee authority to use City property for <br /> certain terms and conditions. <br /> AGREEMENT <br /> In consideration of mutual benefit to the city and other good and valuable consideration, <br /> the receipt and sufficiency of which is hereby expressly acknowledged, the City licenses <br /> Grantee to use the Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. City property located at 6731 Beverly Blvd., <br /> Everett, WA 98203, Tax Parcel No. 28050600401000. <br /> The area of use is generally depicted on Exhibit "A" attached hereto and included herein <br /> by reference. <br /> Section 2. TERM. This License shall be effective for thirty days, beginning October 1st, <br /> 2020, unless terminated earlier per Section 6, below. <br /> Section 3. AUTHORIZED USE. Grantee may only use the Property for food truck <br /> staging and vending services during the hours of [ 4-7pm M-Sat I City shall provide <br /> restroom access for Grantee and its employees. Grantee shall not grant public access <br /> to City-provided restroom. <br /> Section 4. ADDITIONAL CONDITIONS. Grantee shall have no overnight parking or <br /> storage of any kind. No trash, debris, wastewater, or other miscellaneous items may be <br /> disposed of onto the Property. Grantee shall clean up and remove all trash and debris at <br /> the end of each business day. <br /> Section 5. INDEMNIFICATION. Grantee hereby agrees to defend, indemnify and hold <br /> the City harmless from any and all Claims for injury to people or damage to property <br /> arising out of or related to this License. This defense and indemnification obligation shall <br /> survive any termination, revocation or expiration of this Agreement. For the purpose of <br /> page 1 <br />
