<br />ORDINANCE NO. 3917.
<br />AN ORDINANCE annexing certain propertyto the City of
<br />Everett in compliance with Chapter 128 of the laws of the State of
<br />Washington, 1945, as amended, and declaring an emergency to exist.
<br />WHEREAS, pursuant to Section 18, Chapter 282, laws of
<br />the State of Washington, 1961, a petition was presented to the
<br />City of Everett and a hearing was held and determination was made
<br />by the City Council of the City of Everett to annex said territory
<br />and that said area would not be required to assume the debts of the
<br />city incurred at the time of the annexation of said property, and
<br />WHEREAS, a petition was then presented to the City
<br />Council of the City of Everett signed by the owners of not less
<br />than 75% in value of the property to be annexed, as required by
<br />Section 19 of Chapter 282 of the laws of Washington, 1961, and
<br />WHEREAS, the Review Board, as established by Section 2
<br />of Chapter 282 of the laws of Washington, 19451 has reviewed said
<br />petition and approved the annexation, and
<br />WHEREAS, the Commissioners of the City of Everett, a
<br />municipal corporation, did fix the 25th day -of September, 1962, for
<br />hearing upon said petition and caused notice of hearing to be
<br />published in one issue of the Everett Daily Herald, a newspaper
<br />of general circulation in the city, and caused said notice also
<br />to be posted in three (3) places within the territory proposed for
<br />annexation, which notice as published and as posted specified
<br />the time and place of hearing and invited interested persons to
<br />appear and voice approval or disapproval of the annexation, and
<br />WHEREAS, following the hearing the Commissioners of
<br />Everett, a, municipal corporation, have determined to annex all of
<br />the property described in the petition as hereinafter set forth. .
<br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
<br />Section 1: That an emergency is hereby declared to exist,
<br />and this ordinance shall take effect upon its passage and publi-
<br />cation.
<br />Section 2: That the property hereinafter described be,
<br />and the same is hereby annexed to the City of Everett upon the date
<br />of the passage and publication of this ordinance.
<br />That portion of Beverly Berry Tracts, Division
<br />No. 2, in the northeast quarter of Section 14,
<br />Township 28 North, Range 4 E.W.M. as shown on
<br />the accompanying plat and described as follows:
<br />Begin at the northeast corner of Tract 46, Beverly
<br />Berry Tracts, Division No. 2; thence southerly
<br />along the east line of said Beverly Tracts Division
<br />N o. 2 to the southeast corner of said plat; thence
<br />westerly along the south line of said Beverly
<br />Berry tracts, Division No. 2, to the southwest
<br />corner of said plat, thence northerly along the
<br />west line of said Beverly Berry Tracts, Division
<br />N o. 2, to the southwest corner of Tract 32 of
<br />said Beverly Berry Tracts, Division No. 2, thence
<br />easterly along the south lines of Tracts 32, 33,
<br />34, and 35 of said Beverly Berry Tracts, Division
<br />N o. 2 to the southeast corner of said Tract 35;
