City of Everett <br /> Community Development Block Grant Program Agreement <br /> the participation in,be denied the benefits,or be subjected to discrimination under any program or activity receiving Federal <br /> financialassistance. <br /> In connection with the operation of the Property,Grantee shall not: <br /> (1) discriminate against any person on the basis of religion or religious belief and will not limit any <br /> benefits or services or give preference to persons on the basis of religion or religious belief;and <br /> (2) engage in inherently religious activities,such as worship, religious instruction,or proselytization. <br /> (c) Conflict of Interest.Grantee shall ensure compliance with the provisions of 24 CFR Section 570.611,which <br /> provide generally that no officer,agent,employee,consultant or elected or appointed official of the Grantor,who <br /> exercisesorhasexercisedanyfunctionsorresponsibilitieswithrespecttoactivitiesassistedbyCDBGfundsorwhoisina position to <br /> participate in a decision-making process or gain inside information with respect to these activities,shall obtain any financial <br /> interest or benefit from,or have any financial interest in,the activity funded under this Grant Agreement or <br /> anycontractorsubcontractoragreementwithrespecttheretoortheproceedsthereof,forhimselforherselforthosewith whom he or <br /> she has business or immediate family ties; nor shall (s)he for one year after completion of his or her tenure with the Grantor <br /> obtain or have any such financial interest or benefit.Grantee shall incorporate in all such contracts or <br /> subcontractsa provision prohibitinga nyconflictofi nterestprohibitedbythissu bsection. <br /> (d) Debarred Contractors. No portion of the Grant shall be used directly or indirectly to employ,award <br /> contractsto,orotherwiseengagetheservicesof,orfund,anycontractororsubrecipientduringanyperiodofdebarment,suspension,or <br /> placement in ineligibility status of such contractor or subrecipient under the provisions of 2 C.F.R. Part 2424.Grantee represents <br /> and warrants that neither Grantee nor its principals is debarred,suspended, proposed for debarment,declared ineligible,or <br /> voluntarily excluded from participation in federal assistance programs under such <br /> regulationsorExecutiveOrder12549,"DebarmentandSuspension."GranteeshallrequirecompliancewithsubpartCof 2 CFR Part 180, <br /> as supplemented by Subpart C of 2 CFR Part 2424,and shall require that include a term or condition requiring the same <br /> compliance be included in each lower tier"covered transaction"as defined in thoseregulations. <br /> (e) Lobbying.Granteeherebycertifiesandagreesasfollows,inaccordancewith3lU.S.C.Section1352,to the best of its <br /> knowledge andbelief: <br /> (1) NoFederalappropriatedfundshavebeenpaidorwillbepaid,byoronbehalfofGrantee,toany <br /> personforinfluencingorattemptingtoinfluenceanofficeroremployeeofanyagency,amember of Congress, <br /> an officer or employee of Congress,or an employee of a member of Congress in connection with the <br /> awarding of any Federal contract,the making of any Federal Grant,the entering into of any <br /> cooperative agreement,and the extension,continuation,renewal, <br /> amendment,ormodificationofanyFederalcontract,grant,orcooperativeagreement; <br /> (2) If any funds other than Federal appropriated funds have been paid or will be paid to any person for <br /> influencing or attempting to influence an officer or employee of any agency,a member of <br /> Congress,an officer or employee of Congress,or an employee of a member of Congress in <br /> connection with this Federal Grant,it will complete and submit StandardForm- <br /> LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions;and <br /> (3) Grantee shall require that the language of this Section be included in the award documents for <br /> subawards at all tiers (including subcontracts, subgrants, and contracts under grants, and <br /> cooperativeagreements)andthatallsubrecipientsshallcertifyanddiscloseaccordingly. <br /> Thiscertificationisamaterialrepresentationoffactuponwhichreliancewasplacedwhenthistransaction was made or <br /> entered into.Submission of this certification is made a prerequisite for making or entering into this <br /> transactionbysection1352,title3l,U.S.Code.Anypersonwhofailstofiletherequiredcertificationshallbesubjecttoa <br /> civilpenaltyofnotlessthan$10,000andnotmorethan$100,000foreachsuchfailure. <br /> 8 of 10 <br />
