This definition excludes secondhand stores,pawnshops,thrift stores and artwork made from recycled or <br /> previously used materials incorporated into artwork.The planning director is authorized to maintain a list <br /> of stores that qualify as junk stores. <br /> "Pawnshop" means an establishment that engages,in whole or in part,in the business of loaning money on the <br /> security of pledges of personal property,or deposits or conditional sales of personal property,or the purchase or <br /> sale of personal property. <br /> "Secondhand store"means retail sales of previously used merchandise,the majority of which is not donated,such <br /> as clothing,furniture,appliances,household goods,sporting goods, recreational equipment or other merchandise <br /> not considered to be antique,that is in good repair or has been restored or reconditioned to a clean and usable <br /> condition.This definition excludes"pawn shop," "thrift store,"and"junk store."The planning director is <br /> authorized to maintain a list of stores that qualify as secondhand stores. <br /> "Specified anatomical areas"means: <br /> 1. Less than completely and opaquely covered human genitals,pubic region, buttock and female breast <br /> below a point immediately above the top of the areola;and <br /> 2. Human male genitals in a discernible turgid state,even if completely and opaquely covered. <br /> "Specified sexual activities" means: <br /> 1. Human genitals in a state of sexual stimulation or arousal; <br /> 2. Acts of human masturbation,sexual intercourse or sodomy; <br /> 3. Fondling or other erotic touching of human genitals, pubic region, buttock or female breast. <br /> "Thrift store" means a store that derives the majority of its sales from donated previously used merchandise such <br /> as clothing,furniture,appliances,household goods,sporting goods, recreational equipment or other merchandise <br /> not considered to be antique.The planning director is authorized to maintain a list of stores that qualify as thrift <br /> stores. <br /> 19.04.110 Critical areas definitions. <br /> This section defines specific terms to be applied where used in Chapter 19.37. <br /> "Alteration" means any human-induced action which impacts the existing condition of a critical area.Alterations <br /> include but are not limited to grading;filling;dredging;draining;channelizing;cutting,pruning, limbing or topping, <br /> clearing,relocating or removing vegetation;applying herbicides or pesticides or any hazardous or toxic substance; <br /> discharging pollutants;grazing domestic animals;paving,construction,application of gravel; modifying for surface <br /> water management purposes;or any other human activity that impacts the existing vegetation, hydrology,wildlife <br /> or wildlife habitat.Alteration does not include walking, passive recreation,fishing or other similar activities. <br /> "Best available science" means current scientific information used in the process to designate, protect,or restore <br /> critical areas,that is derived from a valid scientific process as defined by WAC 365-195-900 through 365-195-925. <br /> "Biological assessment"is an evaluation of the potential effects of a proposed action on listed and proposed <br /> species and designated and proposed critical habitat and determination whether any such species or habitat is <br /> likely to be adversely affected by the action. <br /> "Biologist"means a person who has earned a degree in biological sciences from a college or university,with <br /> practical experience that includes at least two years'expertise in matters involving wetlands biology or stream <br /> ecology in the Pacific Northwest. <br /> "Bog"means wetlands with extensive living sphagnum moss or sphagnum peat and a distinctive flora that results <br /> from the acidic substrate. <br /> Ch.19.04 Definitions 22 City Council Action(11/04/2020) <br />
