LICENSE TO USE CITY PROPERTY THIS LICENSE AGREEMENT (the "License"), between the City of Everett as Grantor (the "City") and Washington State Food Truck Association, LLC and its authorized members, as the Grantee ("Grantee"), for use of City owned property. RECITALS A. Grantee desires to utilize property owned by the City for mobile food vending ("food truck") services. B. The City is willing to grant Grantee authority to use City property for certain terms and conditions. AGREEMENT In consideration of mutual benefit to the city and other good and valuable consideration, the receipt and sufficiency of which is hereby expressly acknowledged, the City licenses Grantee to use the Property upon the following terms and conditions: Section 1. LICENSED PROPERTY. City property located at 6731 Beverly Blvd., Everett, WA 98203,Tax Parcel No. 28050600401000. The area of use is generally depicted on Exhibit A attached hereto and included herein by reference. Section 2. TERM. This License shall be effective for 6-months, beginning November 1, 2020, through April 30, 2021, unless terminated earlier per Section 6, below. Section 3. AUTHORIZED USE. Grantee may only use the Property for food truck staging and vending services during the hours of 4-7pm Monday-Saturday, or other for approved events. City shall provide restroom access for Grantee and its employees. Grantee shall not grant public access to City-provided restroom. Section 4. CONSIDERATION. Grantee shall pay a fee of $10 per day for each day of on-site use of the Property as shown on the schedule attached as Exhibit B. Section 5. ADDITIONAL CONDITIONS. Grantee shall have no overnight parking or storage of any kind. No trash, debris, wastewater, or other miscellaneous items may be disposed of onto the Property. Grantee shall clean up and remove all trash and debris at the end of each business day. page 1
