RETURN TO <br /> EVERETT CITY CLERK <br /> 2930 Wetmore <br /> Everett, WA 98201 <br /> INTERLOCAL AGREEMENT BETWEEN THE PORT OF EVERETT <br /> AND THE CITY OF EVERETT REGARDING THE COOPERATIVE USE <br /> OF FACILITIES, EQUIPMENT, AND RESOURCES <br /> SECTION 1.PARTIES <br /> This Interlocal Agreement (hereinafter "Agreement") is entered into this if dkday of J u Kti- , <br /> 2003, by and between the Port of Everett, a municipal corporation, hereinafter referred to as "Port" <br /> and the City of Everett, a municipal corporation, hereinafter referred to as"City." <br /> SECTION 2.RECITALS <br /> WHEREAS, both the Port and the City have facilities and other resources which, on <br /> occasion, the other would find beneficial to use; and <br /> WHEREAS, it is in the public's interest for these two entities, whenever possible and <br /> practicable,to share facilities and resources; and <br /> WHEREAS, the Port and the City desire to formalize an operational framework that will <br /> encourage and promote the coordination and usage of the facilities and resources of both entities; <br /> and <br /> WHEREAS, pursuant to the powers accorded to the Port and the City per RCW Chapter <br /> 39.34.010,the Port and the City possess the authority and desire to execute an intergovernmental <br /> cooperation agreement for this purpose; <br /> NOW,THEREFORE,in consideration of the mutual benefits of this Agreement, the <br /> parties agree as follows: <br /> SECTION 3.TERMS AND CONDITIONS <br /> 3.1 The Director of the Port and the Mayor of the City are hereby authorized to execute facility <br /> use permits and letters of understanding that, by this reference, shall become a part of this <br /> Agreement, provided that such permits and letters are signed by both parties and reference this <br /> Agreement. The permits and letters of understanding shall address issues relating to sharing <br /> facilities and resources controlled or owned by the parties. The permits and letters of understanding <br /> shall not supercede any agreement between the parties in effect upon the date of execution of this <br /> Agreement. The permits and letters of understanding shall be limited to utilization of existing <br /> facilities and shall not be for the purpose of the construction of facilities (e.g., City's utilization <br /> of a Port facility for a public meeting, Port's utilization of City facility for a community <br /> meeting). Any letter of understanding shall not exceed two (2)years in duration. The permits and <br /> letters of understanding may address, but are not limited to,the following: <br /> • Duration of agreement <br /> • Use of facilities, equipment <br /> • Access to facilities,equipment <br /> 1 <br />
