EVERETT <br /> WASHINGTON <br /> ORDINANCE NO. 3782-20 <br /> An ORDINANCE Relating to Traffic Mitigation Fees,AMENDING Ordinance No. 3774-20 <br /> WHEREAS, <br /> A. The City of Everett did its last major update of the City's Traffic Mitigation Fee in 2014, increasing <br /> the Traffic Mitigation Fee to $2,400 per PM peak hour trip. The 2014 update also included an <br /> inflation index that adjusts the Traffic Mitigation Fee annually, based on the Washington State <br /> Department of Transportation's (WSDOT) Construction Cost Index (CCI). <br /> B. In 2020, the City retained Gibson Traffic Consultants, Inc. (GTC) to provide updated calculations <br /> of the City of Everett's Transportation Mitigation Fee. <br /> C. The City held a public hearing on December 16, 2020. <br /> D. Accordingly,this ordinance revises the Traffic Mitigation Fee, increasing it to$3,994 per PM peak <br /> hour trip. Further, because the WSDOT CCI ceased to be updated in 2016, this ordinance also <br /> changes the inflation index to the Federal Highway Administration (FHWA) National Highway <br /> Construction Cost Index (NHCCI). <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 19.51.100 of Section 5.Z of Ordinance 3774-20 (codified at EMC 19.51.100) is <br /> amended as follows, with underlined text added and strike-out text deleted: <br /> 19.51.100 Fair share for system improvements. <br /> A. Two Components of Fair Share.This section specifies the mitigation for transportation system <br /> improvements, unless otherwise agreed by the city traffic engineer.The fair share shall consist of <br /> two components: <br /> 1. A fee for each peak hour trip calculated to provide a fair share, attributed to new <br /> development, of the cost of"planned system improvements" (see subsection D of this section <br /> for fee amount); plus <br /> 2. Responsibility for a fair share of cost of additional improvements, if any,to maintain <br /> acceptable levels of service as a result of the proposed project(see Table 2 and subsection B of <br /> this section for method of calculating the fair share). <br /> When level of service"D"or better will be met at the horizon year with the project,the <br /> applicant shall not be required to pay a fair share contribution for additional transportation <br /> system improvements.This section does not duplicate, replace, or substitute for any local <br />
