BUSTARP OL'STOA1 OONSTRUCT/ON, ,/iW, <br /> P.O, BOX>2 3 <br /> MARYSV/LLIIrA 95270 <br /> 125-878-a 51. <br /> City of Everett Hold Harmless Agreement <br /> March 30, 2019 <br /> Tony Lee <br /> Building Official <br /> City of Everett Public Works <br /> 3200 Cedar Street <br /> Everett WA 98201 <br /> Dear Mr. Lee: <br /> This letter is intended to formally request that Bustard Custom Construction, Inc. be allowed to submit <br /> SFR construction permit applications for our SS17004 Lot 2 Florida Drive project prior to final short plat <br /> approval by the Planning Department and recording of the plat map. <br /> We acknowledge to the City that Bustard Custom Construction understands the risks associated with <br /> submitting the building permit application prior to recording of the short plat and further understands <br /> that submitting for a building permit does not vest the project or imply that land use approvals will be <br /> given or that recording will happen. <br /> Finally, Bustard Custom Construction agrees to hold the City of Everett harmless for the loss of paid <br /> application fees,design fees,and other fees that may be incurred if the short plat does not get <br /> recorded,or the short plat final review/recording timeframe creates a feasibility issue related to the <br /> project or requires additional design modifications subsequent to submittal of the building permit. <br /> Sincerely, <br /> tflBustard <br /> President <br /> Acceptance of Hold Harmless Date <br />
