and/or injury to the District's property, facilities and/or appurtenances that are installed, <br /> constructed, and/or placed in, under, and/or upon the City's sidewalk, and expressly waives any <br /> right of recovery for damage thereto. Further, the District understands that the City will continue <br /> to use the sidewalk for its intended purposes, and that District has no duty to protect the City's <br /> property, facilities and/or appurtenances from injury or damage caused thereby. <br /> 10. Insurance. <br /> a. At all times while this License is in effect, the District shall provide evidence of <br /> self insurance or carry general liability and property damage insurance covering the District's use <br /> of the City's sidewalk in the following limits: <br /> • Bodily Injury each person $1,000,000 <br /> (including death) each person $1,000,000 <br /> • Property Damage each person $1,000,000 <br /> • Combined Single Limit $2,000,000 <br /> b. When reference is made in said insurance to the District's "use" of the City's <br /> sidewalk, such reference shall include use of the said property by the District, its employees, <br /> agents, servants, guests, business invitees or any of them, or by any other persons using or <br /> occupying the premises with the knowledge or consent of the District. This shall not be construed <br /> as expanding any rights or any right to use of the City's sidewalk beyond that specifically granted <br /> in this License. <br /> d. The District shall provide the City with evidence of self-insurance and/or <br /> Certificates of Insurance as evidence of said insurance prior to the District's use of the City's <br /> sidewalk pursuant to this License. Certificates of Insurance shall be authenticated by the proper <br /> officer of the insurer and shall state in particular those insured, the extent of the insurance, the <br /> location and operations to which the insurance applies, the expiration date and the <br /> below-mentioned notice of cancellation clause. <br /> e. The District shall not cause such insurance to lapse or be canceled during its use of <br /> the City's sidewalk for the term of this License. <br /> f. The insurance requirements contained herein shall not in any manner be deemed to <br /> limit or qualify the liabilities and/or obligations of District under this License. <br /> 20. License is Not Transferable. This License is not transferable. <br /> 21. Severability. <br /> a. If a court of competent jurisdiction holds any part,term or provision of this License <br /> to be illegal or invalid in whole or in part, the validity of the remaining provisions shall not be <br /> affected, and the Parties' rights and obligations shall be construed and enforced as if this License <br /> did not contain the particular provision held to be invalid. <br /> Limited Use License Page 3 <br />
