This customer information is used to make sure
that when there is a false alarm at a location, the alarm owner is notified of the
false alarm and the correct alarm company is sent the bill for the false alarm
response fee. ADT Security Services, an alarm monitoring company, requested
that their customer information be protected by a confidentiality agreement.
The confidentiality agreement protects information from release except when
required by law.
The agreement restates restrictions already codified in Washington State Law
that protect alarm company subscriber information from public disclosure. It
adds a requirement to notify ADT Security Services of any disclosure made if one
is required by law or ordered by a court. The agreement indemnifies ADT
Security Services from any breach of the confidentiality agreement by the City or
the third -party administrator.
Recommendation (exact action requested of Council):
Authorize the Mayor to sign the confidentiality agreement with ADT Security
Services regarding the sharing of alarm subscriber information.
