The contaminated soils extend beyond Riverview's <br />property and into the adjacent East Marine View Drive right of way. The Environmental <br />Covenant and Agreement specifies the liability and responsibilities of Riverview I, LLC and holds <br />the city harmless for the clean-up of the contaminated soils within the East Marine View Drive <br />right of way. The on -site portion of the clean-up is substantively complete and was accomplished <br />by removing and transporting the impacted soils to an approved thermal treatment site for <br />remediation. Clean-up of the impacted soils within the right-of-way is being conducted with the <br />soils left in -place using a bio-remediation process. This work is ongoing. This amendment <br />extends the term of the Environmental Covenant and Agreement for 2 additional years until <br />January 1, 2023. <br />Recommendation (exact action requested of Council): <br />Authorize the Mayor to sign the Amendment providing a 2-year extension of the Environmental <br />Covenant and Agreement between the City of Everett and Riverview I, LLC for clean-up of <br />contaminated soils within the East Marine View Drive right-of-way. <br />
