AMENDMENT NO.6 PROFESSIONAL SERVICES AGREEMENT (PUBLIC DEFENSE OVERSIGHT) This Amendment No. 6 is dated for reference purposes January 1, 2021. It is by and between the City of Everett, a m»nicipal corporation under the laws of the State of Washington("City")and Mark D.Mestel,Inc. P.S. ("Attorney Service Provider"). RECITALS A. The City and Attorney Service Provider are parties to the Professional Services Agreement dated August 11,2015, as amended(the"Agreement"),under which Attorney Service Provider provided public defense oversight services during the later portion of 2015, and years 2016,2017,2018,2019 and 2020. B. The City and the Attorney Service Provider desire to amend the Agreement so that Attorney Service Provider will also provide the public defense oversight services during calendar year 2021. AGREEMENT The City and Attorney Service Provider agree as follows: 1. The Agreement is modified sa that the expiration of the Agreement is February 28, 2022. For 2021 Work, the Attorney Service Provider shall provide two reports,one due July 1,2021,and the second due February 28,2022. 2. Section 4 of the Agreement as amended is further modified by adding the underlined phrase as set forth below: Compensation. The City shall pay the Attorney Service Provider$150.00 per hour,up to a total cumulative maximum of$45,000 for Work in 2015, and up to a total cumulative maximum of$30,000 for Work in 2016, and up to a total cumulative maximum of$30,000 for Work in 2017,and up to a total cumulative maximum of$24,004 for Work in 2018, and up to a total cumulative maximum of$24,000 for Work in 2019,and up to a total cumulative maximum of$24,000 for Work in 2020 and includes Work for the report due February 28, 2021, and up to a total cumulative maximum of $24,000 for Work in 2021 and includes Work for the report due February 28, 2022. This payment is full compensation for such Work performed and services rendered, including, but not limited to, all labor, materials, supplies, equipment and incidentals necessary to complete the Work. 3. Regardless of the date(s) on which this Amendment is signed by the parties, the parties agree that the Agreement has been continuously in effect since August 11, 2015.
