If the interference cannot be so mitigated or if such a meeting for any <br /> reason cannot be so convened,then the Owner shall cause at no cost to the City the relocation <br /> of all City-determined interfering PSE Lines to locations outside of the easement area of the <br /> Existing City Easement The Owner acknowledges and agrees that during such interference <br /> the City's ability to operate and maintain the water lines within the Existing City Easement <br /> may be affected and water service to the Property may not occur, all as determined by the <br /> City in its sole and absolute discretion. <br /> 4. This Agreement is subject to the laws of the State of Washington. Exclusive <br /> venue for any dispute arising from this Agreement is Snohomish County Superior Court. <br /> The failure of a party to enforce at any time any of the provisions of this Agreement shall <br /> not be deemed to be a waiver of the right of a party thereafter to enforce any such provisions. <br /> No amendment to this Agreement shall be valid unless in writing and signed by all parties. <br /> This Agreement may be executed in counterparts,each of which so executed will be deemed <br /> to be an original and such counterparts together will constitute one and the same Agreement. <br /> [signature pages attached] <br /> 3 <br />
