Community Transit shall provide all federally mandated ADA paratransit <br />trips that begin outside of Zones 2 and 3 and end anywhere within Zone 1. <br />b. Community Transit shall provide all federally mandated ADA paratransit <br />trips that begin anywhere within Zone 1 and end outside Zones 2 or 3. <br />c. Community Transit shall provide all federally mandated ADA paratransit <br />trips that begin and end anywhere within Zone 3. <br />4. Coordination of Trips <br />a. Everett Transit and Community Transit shall coordinate to provide <br />transfers between agencies for federally mandated ADA paratransit trips <br />that begin outside of Zones 2 and 3 and end within those areas of Zone 2 <br />that are not also within Zone 1. <br />b. Between agencies for federally mandated ADA paratransit trips that <br />begin within the area of Zone 2 that is also not within Zone 1 and end <br />outside of Zones 2 and 3. <br />5. Mutual Responsibility. This Letter of Understanding documents the operational <br />plan for provision of federally mandated services in a geographic area of mutual <br />responsibility. Each agency agrees to plan, fund, and deliver the services <br />assigned to them within this agreement in a manner that is consistent with all <br />applicable ADA paratransit service standards. However if either party is unable to <br />meet the demand for a federally mandated trip in an area of mutual responsibility, <br />the other party will endeavor to provide mutual aid to ensure that federal <br />requirements are met. <br />6. Communication and Coordination. The parties will maintain ongoing communication <br />and coordination in the delivery of these services and will evaluate the effectiveness <br />of the operational plan at least annually. <br />Incorporation. This Letter of Understanding is incorporated by reference into the Inter - <br />local Agreement Between Snohomish County Public Transportation Benefit Area <br />Corporation (Community Transit) and the City of Everett (Everett Transit) Regarding the <br />Cooperative Provision of Services and will remain in effect for the duration of that <br />agreement or until amended or superseded in writing. <br />Replacement. This Letter of Understanding supersedes the prior Letter of <br />Understanding dated on or about December 1, 2009. <br />
