MEMORANDUM OF UNDERSTANDING <br /> Between City of Everett <br /> And <br /> Everett Police Management Association (EPMA) <br /> I. PURPOSE: <br /> This Memorandum of Understanding(MOU)outlines the mutual understanding between the parties <br /> regarding compensatory time (Article 13.2.2). <br /> II. SCOPE: <br /> This agreement is applicable to all EPMA employees. <br /> III. AGREEMENT: <br /> WHEREAS, the EPMA collective bargaining agreement for 2021-2022 was recently ratified by <br /> EPMA and City Council, and Section 13.2.2 was changed to increase compensatory time to 120 <br /> hours; <br /> WHEREAS, Section 13.2.2 previous and current language states that Lieutenants and Captains <br /> may not cash out their compensatory time; <br /> WHEREAS, a recent audit identified that EPMA members have been allowed to cash out 80 <br /> hours of compensatory time at separation of service in accordance with Ordinance 2494.00 <br /> Section 2.72.100 (E2) (Compensatory Time for FLSA Exempt Employees); <br /> WHEREAS,the City and Union seek to clarify Section 13.2.2 of the EPMA collective bargaining <br /> agreement; <br /> NOW,THEREFORE, the parties agree that: <br /> • Effective January 1, 2021, employees may accrue 120 hours of compensatory time in <br /> accordance with the EPMA collective bargaining agreement, Section 13,2.2 <br /> • Effective January 1, 2021, employees may cash out a maximum of 80 hours of <br /> compensatory time at separation of service in accordance with Ordinance 2.72.100 (E2). <br /> • Any dispute and/or difference as to the meaning and/or interpretation of any portion of <br /> this MOU shall be resolved through the grievance-arbitration provisions of the CBA. <br /> • This MOU will become effective upon the final signature being affixed to the MOU. <br /> EXECUTED, this_ day of 4 . &14A/ , 2021 for Everett Police <br /> Management Association: 111 <br />
