e) The YMCA may request to add features at its own expense to the property that would enhance <br /> the program and the general facility. Those items that are not portable become property of the <br /> City of Everett. <br /> 7. CONDUCT OF CAMP PROGRAMMING <br /> a) The YMCA is solely responsible for camp programming. The YMCA is responsible for the conduct <br /> of employees, agents, contractors, campers,and guests. The YMCA shall provide adequate <br /> supervision at all times at a ratio in accordance with standard practices for well-run day camp <br /> programs. <br /> b) The YMCA is responsible for providing at the YMCA's cost all labor,equipment,oversight and all <br /> else needed for camp programming,as determined by the YMCA. For example,the YMCA will <br /> provide all equipment for all uses of the Camp Patterson Facilities under this Agreement, <br /> including, without limitation, honey buckets, handwashing stations and boats. <br /> c) The YMCA will provide a certified lifeguard at all times when campers are swimming or boating. <br /> 8. CITY STAFFING <br /> The City will provide staffing to assist with facility use coordination. <br /> 9. MARKETING AND PROMOTION <br /> The City will assist in the marketing and promotion of the YMCA, provided that the YMCA is in <br /> compliance with all City policies. <br /> 10. RISK MANAGEMENT <br /> The YMCA shall immediately or on or before the expiration of one working day record and report to the <br /> City all injuries and claims against it for bodily injury and property damage relating to Camp Patterson. <br /> The YMCA shall immediately notify the City of any safety hazards that are apparent at Camp Patterson <br /> that the YMCA cannot immediately remedy. <br /> 11. INSURANCE <br /> a) The YMCA shall procure and keep in force during the term of this Agreement, at the YMCA's <br /> own cost and expense,the policies of insurance described herein with companies authorized to <br /> do business in the State of Washington,which are rated at least "A" or better and with a <br /> numerical rating of no less than 7, by A.M. Best Company and which are acceptable to the City. <br /> b) The YMCA shall procure and maintain Commercial General Liability Insurance on an occurrence <br /> basis in an amount not less than$1,000,000 per occurrence and at least$5,000,000 in the <br /> annual aggregate, including but not limited to premises/operations (including off-site <br /> operations), blanket contractual liability and broad form property damage, all in a form <br /> acceptable to the City. <br /> 3 <br />
