MEMORANDUM OF UNDERSTANDING <br /> By and Between <br /> City of Everett <br /> and <br /> Everett Police Officers Association <br /> RESOLUTION OF THE EPOA'S SEPTEMBER 10,2020,UNFAIR LABOR PRACTICE <br /> COMPLAINT <br /> The City of Everett (City) and the Everett Police Officers Association (EPOA) <br /> (collectively,the Parties)enter into this Memorandum of Understanding(MOU). <br /> WHEREAS, the City and the EPOA are signatories to a January 1, 2020, through <br /> December 31, 2022 collective bargaining agreement (CBA) setting forth the wages, hours, and <br /> other terms and conditions of employment for members of the bargaining unit represented by the <br /> EPOA; <br /> WHEREAS, on August 3,2020,the City notified the EPOA that it intended on changing <br /> the job requirements for a non-represented Police Inspector appointment,which included <br /> removing supervisory experience as a requirement for the appointment; <br /> WHEREAS,that same day,the EPOA submitted a formal demand to bargain over the <br /> City's decision to change the job description for the Police Inspector appointment by eliminating <br /> supervisory experience as a requirement; <br /> WHEREAS, on August 20,2020,the parties met to bargain the change to the job <br /> requirements for the Police Inspector appointment; <br /> WHEREAS, on August 24,2020,the City internally posted the job announcement for the <br /> Police Inspector appointment; <br /> WHEREAS, the EPOA filed an unfair labor practice complaint (ULP), on September 10, <br /> 2020, alleging that the City violated the Public Employees' Collective Bargaining Act by <br /> unilaterally changing the job requirements for the unrepresented Police Inspector appointment <br /> which impacted promotional opportunities for the EPOA's bargaining unit members;and <br /> WHEREAS, the City and the EPOA wish to resolve the ULP and are entering into this <br /> MOU to set out the terms of their agreement for resolving the ULP; it is therefore: <br /> AGREED BY AND BETWEEN THE PARTIES HERETO,in consideration of the mutual <br /> promises contained herein and other good and valuable consideration,that: <br /> 1. The City's Chief of Police shall have full appointment authority for the positions <br /> of Police Inspector and Deputy Chief. <br /> 2. The City will create a new full-time sergeant position and fill it by May 1, 2021. <br /> The parties may extend the May 1 deadline by mutual agreement. <br /> 1 <br /> ULP RESOLUTION MOU <br />
