I <br /> I City of Everett,WA <br /> PW No.2020-064-R1 <br /> Emma Yule Park <br /> I ****ADDENDUM#1**** <br /> Date: January 19, 2021 <br /> I <br /> THIS ADDENDUM BECOMES PART OF THE CONTRACT DOCUMENTS AND <br /> 11 MODIFIES THE ORIGINAL PROJECT MANUAL. <br /> The items below shall be made to the Project manual: <br /> IREVISION 1: Invitation for Bid, Bids due section has been revised to read: <br /> 1 Bids will be received until February 2nd at 2:00pm PST, at the Purchasing Counter, Door #5, <br /> 3200 Cedar Street, Everett WA, 98201. The Purchasing Counter is open Monday-Friday,from <br /> 8:00am - 3:00pm. <br /> IAt the appointed time, all bids will be opened and read aloud publicly via webcast only. The link for <br /> the webcast is located at https//wwnv. everettwa.gov/319/purchasing. <br /> I <br /> REVISION 2: Agreement (Contract), Section 00 52 13, Contract, Section paragraph 2, Contract <br /> 1 Time has been revised to read: <br /> DELETE: Contract Time: Substantial Completion of the Work shall be by December 31, 2020. The <br /> 1 completion date shall be January 31, 2021. <br /> ADD: Contract Time:Substantial Completion of the Work shall be 245 calendar days from the date <br /> I of the Notice to Proceed. The Physical Completion of the Work shall be 30 calendar days from the <br /> date of Substantial Completion. <br /> IREVISION 3: Section 00 52 13, Contract, Section 3, Liquidated Damages has been revised to read: <br /> I DELETE: The parties agree the City will suffer damage and be put to additional expense in the event <br /> that the Contractor does not complete the Work in all respects and have it ready for use by the <br /> Substantial and Physical Completion dates stated above. Because it is difficult to accurately compute the <br /> I amount of such costs and damages, the Contractor hereby covenants and agrees to pay to the City <br /> liquidated damages for each and every calendar day(or working day, if Contract Time is described in <br /> working days)in the amounts set forth in this Section. For failure to achieve Substantial Completion by <br /> Ithe Substantial Completion date stated above, the Contractor shall pay liquidated damages to the City <br /> computed at the daily rate of fifteen percent(15%) of the Contract Sum multiplied by the number of days <br /> that it took the Contractor to achieve Substantial Completion that exceeded Contract Time divided by the <br /> I number of days of Contract Time stated above. Once Substantial Completion is achieved,for failure to <br /> achieve Physical Completion by the Physical Completion Date stated above, the Contractor shall pay <br /> liquidated damages at the daily rate of ten percent (10%) of the liquidated damages rate applicable to <br /> 1 delays to Substantial Completion. <br /> ADD: The parties agree the City will suffer damage and be put to additional expense in the event that <br /> the Contractor does not complete the Work in all respects and have it ready for use by the Substantial and <br /> I <br />
