1 <br /> Section 00 21 13 <br /> ' INSTRUCTIONS TO BIDDERS <br /> new or revised criteria. Any protest of a City decision regarding <br /> ' a request for criteria modification must be in strict conformity <br /> with Everett Municipal Code Chapter 3.46, Bid Protest <br /> Procedures. <br /> b. Additional Information. The City may from time to time require <br /> that the Bidder submit information in addition to the Bidder's <br /> Qualifications Statement. <br /> ' c. Appeal/Protest of Responsibility Decision. If the City determines <br /> the Bidder does not meet the bidder responsibility criteria above <br /> ' and is therefore not a responsible bidder,the City will notify the <br /> Bidder in writing with the reasons for its determination. If the <br /> Bidder disagrees with this determination,the Bidder may appeal <br /> ' to the City parks director by presenting additional information to <br /> the City parks director in writing within one business day after <br /> receipt of the City's determination. The City's parks director will <br /> ' consider the additional information and will issue his decision <br /> regarding the appeal. Any protest by Bidder of the parks <br /> director's decision must be in strict conformity to Everett <br /> ' Municipal Code Chapter 3.46, Bid Protest Procedures, which <br /> (among other requirements) requires that any protest be filed <br /> with the City Clerk no later than the business day prior to the date <br /> of City Council proposed award or rejection of all bids. The City <br /> will not execute a contract with any other Bidder until two <br /> business days after the Bidder determined to be not responsible <br /> has received the parks director's decision or, if a protest is filed <br /> under Everett Municipal Code Chapter 3.46, until two business <br /> days after the Bidder receives written notice of City final <br /> ' determination of the protest. <br /> B. PRE-AWARD CONFERENCE <br /> After Bid opening, but prior to award, the apparent successful Bidder shall attend a pre-award <br /> conference to respond to questions by the City regarding evaluation of Bids. The City will <br /> emphasize items such as insurance and bonding that will assist in prompt issuance of the Notice <br /> ' to proceed. By conducting a pre-award conference, the City has not thereby waived its right to <br /> make determinations regarding responsiveness and responsibility of the Bidder. <br /> C. ACCEPTANCE OF BID <br /> Within 60 days after the opening of Bids,the City will act either to accept the Bid from the lowest <br /> responsive, responsible Bidder, or to reject all Bids. The City reserves the right to request <br /> ' extensions of such Bid acceptance period. The acceptance of a Bid will be evidenced by a written <br /> Notice of Award of Contract delivered in person or by certified mail to the Bidder whose Bid is <br /> accepted, together with a request to furnish a performance and payment bond and evidence of <br /> ' insurance and to execute the Contract set forth in the Contract Documents. <br /> Bidder has 15 calendar days after receiving the Notice of Award to submit the following <br /> documents to the City: <br /> ' Emma Yule Park 7 of 11 <br /> I <br />
