Section 00 21 13 ' INSTRUCTIONS TO BIDDERS 1.18 State Sales Tax The Washington State Department of Revenue has issued special rules on the State sales tax.This section is meant to clarify those rules. The Contractor should contact the Washington State Department of Revenue for answers to questions in this area.The City will not adjust its payment if the Contractor bases a Bid on a misunderstood tax liability. The Contractor shall NOT include State retail sales taxes in the UNIT bid prices. A separate line item for applying State retail sales tax is provided in the Bid Form. The City will pay the retained percentage only if the Contractor has obtained from the Washington State Department of Revenue a certificate showing that all Contract-related taxes have been paid (RCW 60.28.050).The City may deduct from its payments to the Contractor the amount the Contractor may owe the Washington State Department of Revenue,whether the amount owed relates to this contract or not. The amount so deducted will be paid into the proper State fund. 1.19 Limitations Regarding Contractor's Claims for Damages Bidders should review the Contract Documents regarding limitations on claims for damages. ' 1.20 Delays and Interference Bidders should review the Contract Documents regarding delays and interference. 1.21 Bidder's Check List ' A. The Bidder's attention is especially called to the following forms that must be executed in full as required and submitted with the Bid: ' 1. Bid Form: The lump sum and unit price items must be shown in the space provided. Show unit prices in both words and figures. 2. Proposed Subcontractors Form: To be filled in by the Bidder. 3. Bid Bond: This form is to be executed by the Bidder and the surety company unless Bid is accompanied by a certified or cashier's check. The amount of this bond, which shall be not less than five percent of the Total Bid Amount bid, may be shown in dollars or on a percentage basis. 4. Minority Business Enterprise: To be filled in and signed by the Bidder. 5. Non-Collusion Affidavit: To be signed and submitted with the Bid. Failure to complete the aforementioned forms and to submit said forms with the Bid shall be due cause for rejection of Bid. ' 6. Signed Copies of all Addenda. B. The apparent low Bidder and apparent second low bidder shall submit, to the City Clerk, the following no later than 2 business days after Bid opening, unless the City's project manager in writing allows additional time: 1. Bidder's Qualifications Statement: To be filled in and signed by the Bidder.
