CITY OF EVERETT SPECIAL PROVISIONS <br /> ' 1-06.3(1) Inspection at Point of Manufacturing <br /> (******) <br /> The Contractor shall be responsible to reimburse the City for the costs of inspections at the point <br /> of manufacturing for inspections occurring outside of Whatcom, Skagit, Island, Snohomish, King, <br /> Pierce and Thurston counties. Costs to be paid or reimbursed by the Contractor include, but are <br /> ' not limited to, travel, subsistence, labor and lodging expenses of the City Inspector. <br /> Point of manufacturing inspection will be required if: <br /> Inspection and testing of materials or Equipment in the vicinity of the Work by the City is not <br /> ' practicable, <br /> The Contractor requests the City to inspect and test material or Equipment at the point of <br /> manufacture, or <br /> The Standard Specifications or these Special Provisions require that inspection, testing or <br /> witnessing of tests take place at the point of manufacture. <br /> 1-06.4 Handling and Storing Materials <br /> Supplement 1-06.4 by adding the following: <br /> Contractor shall store materials and Equipment so as to insure the preservation of their quality <br /> and fitness for the Work. Store Equipment and materials at location that facilitates inspection. <br /> ' The Contractor shall be responsible for damages, loss or casualty occurring to materials and <br /> Equipment until Final Acceptance. <br /> 1-06.6 Recycled Materials <br /> ' Delete 1-06.6 and its subsections and substitute the following: <br /> The Contractor shall make best effort to utilize recycled materials in the construction of the project <br /> as detailed in elsewhere in the Standard Specifications and these Special Provisions. <br /> ' Prior to Physical Completion Contractor shall report the quantity of recycled materials utilized in <br /> the construction of the project for each of the items listed in Section 9-03.21. Include hot mix <br /> asphalt, recycled concrete aggregate, recycled glass, steel furnace slag and other recycled <br /> materials (e.g. utilization of on-site material and aggregates from concrete returned to the <br /> supplier). Contractor shall provide report on DOT form 350-075A Recycled Materials Reporting. <br /> 1-07 LEGAL RELATIONS AND RESPONSIBILITIES TO THE PUBLIC <br /> ' 1-07.1 Laws to be Observed <br /> Revise 1-07.1 by replacing the second sentence of the first paragraph with the following: <br /> ' The Contractor shall indemnify, defend, and save harmless the City (including its agents, officers, <br /> and employees) against any claims that may arise because the Contractor (or any employee of <br /> the Contractor or Subcontractor or materialperson)violated a legal requirement. <br /> ' Supplement 1-07.1 by adding the following: <br /> The Contractor shall be in compliance with all applicable standards, orders, or requirements <br /> issued under Section 306 of the Clean Air Act[42 U.S.C. 1857(h)], Section 508 of the Clean Water <br /> ' Act (33 U.S.C. 1368), Executive Order 11738, and Environmental Protection Agency Regulations <br /> (40 CFR Part 15). (Contracts, subcontracts, and subgrants of amounts in excess of$100,000). <br /> The Contractor shall comply with mandatory standards and policies relating to energy efficiency <br /> that are contained in the state energy conservation plan issued in compliance with the Energy <br /> Policy and Conservation Act (Pub. L. 94-163). <br /> The City advises all general contractors and subcontractors that numerous Federal, State, and <br /> ' Local regulations exist that could affect the procedures used in the completion of this project. The <br /> City advises each prospective Contractor that they are responsible to be aware of and comply <br /> with all applicable statutes and regulations.
