CITY OF EVERETT I I:ill <br /> PROFESSIONAL SERVICES AGREEMENT <br /> EVERETT <br /> THIS AGREEMENT made and entered into on this 1st day of January, 2021,by and between the <br /> CITY OF EVERETT.a municipal corporation under the laws of the State of Washington, hereinafter <br /> referred to as the "City," and NVL Laboratories Inc.,whose address 4708 Aurora Ave. N., Seattle, <br /> WA, 98103, hereinafter referred to as the"Service Provider." <br /> WHEREAS,the City desires to engage Service Provider to provide Lead Based Paint(LBP) <br /> activities to include, but not limited to: XRF site testing/inspections, risk assessment, on-site <br /> management, air monitoring, clearance inspections, preparing LBP bid specifications, soliciting <br /> LBP contractors, and training contractors in "Safe Work Practices"activities for the City of <br /> Everett;and <br /> WHEREAS. Service Provider represented,and by entering into this Agreement now represents,that it is <br /> fully qualified to perform the work to be performed hereunder in a competent and professional manner; <br /> NOW,THEREFORE,the parties herein do mutually agree as follows: <br /> 1. Engagement of Service Provider. In a competent and professional manner, Service Provider <br /> shall provide the following services(hereafter referred to as"Work"): <br /> Each City of Everett CHIP housing rehabilitation project,over$5,000 in value, built prior to <br /> 1978, when Lead Based Paint was commonly used, must be tested for the presence and condition <br /> of Lead Based Paint on every interior and exterior surface. The Service Provider will perform <br /> Lead Based Paint XRF inspections, risk assessments,on-site management,air monitoring, and <br /> clearance inspections. <br /> Work includes: <br /> • NVL Laboratories, Inc., provides EPA Certified Inspector/Risk Assessor performs work. <br /> • XRF Spectrum Analyzer testing and two copies of Lead Based Paint Risk Assessments. <br /> • If Lead Based Paint is present, a defined remediation/action options are provided for <br /> CHIP Housing Inspector/Advisor and the contractor's use <br /> • Inspection of the project during the course of the work and at the end, performing all <br /> required clearance sampling and providing one bound copy and one electronic copy of the report <br /> • Performing wipe and soil sampling, including delivery costs and lab analysis <br /> • On site observation of contractor to ensure compliance of regulations <br /> • Teach HUD approved lead RRP safety training program (renovation, repair, & painting). <br /> • On site air monitoring, if applicable. <br /> Page 1 <br /> (Form Approved by City Attorney's Office January 1,2010,updated November 4,2020) <br />
