the responsibility of the school and would contact the school about problems with the <br />facility. He stated that if anything happens at the project, "ECC would be in the <br />headline." The Appellant also contended that the project poses a threat the financial viability of the <br />College's student housing, alleging that the apparent intention of the Project is to draw <br />students away from the College dorms by marketing an unsupervised student <br />environment to on -campus residents. The Appellant asserted that the Applicant initially <br />intended to build market rate apartments for urban professionals in the area, but changed <br />the proposal to "student housing" when they realized the project could not meet the <br />parking requirements for the market -rate housing use. Exhibits E-12, E-13, and E-1; Pat <br />Sisneros Testimony. <br />21. The City adopted its Institutional Overlay Zone in 1992. The regulations established its <br />purpose as the following: <br />The institutional zone is intended to allow for the establishment, expansion, and <br />revision of institutional uses including, but not limited to, colleges, schools, <br />hospitals, government facilities, and social services located in use zones where <br />such uses are not already listed as permitted uses. Such uses and closely related <br />uses ancillary to the principal institutional use shall be established through the <br />master plan review process. <br />ECC 19.33B.020. Thus, the Institutional Overlay Zone exists to allow additional <br />institutional uses not otherwise permitted; it does not prohibit development that is <br />allowed by the underlying zone. The intent of the Overlay Zone is further explained as <br />follows: <br />The approval by the city council of a master plan for an institutional zone shall <br />have the effect of a general guide for fixture development within the institutional <br />zone. The approved master plan shall remain binding upon the sponsoring <br />institution and the city. The review of an individual phase or of the entire <br />development as well as the review of any revision or change shall be in <br />accordance with the review processes described in Title 15, Local Project Review <br />Procedures. <br />ECC 19.33B. 060. <br />financial aid programs are required to maintain and disclose campus crime statistics and security information. <br />Crimes that must be reported include: murder, sex offenses, robbery, aggravated assault, burglary, motor vehicle <br />theft, arson, and arrest. <br />Findings, Conclusions, and Decisions in the Everett Comm.
