Riverview is conducting an environmental cleanup in coordination with the <br />Pollution Liability Insurance Agency ("PLIA") under the Petroleum Technical Assistance <br />Program, Project #$(the "Cleanup"). The Cleanup is the subject of remedial action under <br />the Model Toxics Control Act ("MTC.A"), Chapter 70.105D RCW. <br />B. The Riverview's real property subject to Cleanup is legally described in Exhibit A <br />(the "Riverview Property") <br />C. A portion of the Cleanup site is within the public right-of-way and located beneath <br />a concrete sidewalk and a paved street (East Marine View Drive). This area of City public right- <br />of-way is described on Exhibit B and is referred to in this Covenant as the "City Property". <br />D. The City has agreed to allow Riverview to enter City Property to perform the <br />Cleanup, provided that Riverview is responsible for all costs related to the Cleanup. <br />
