ORDINANCE NO. 3892, AN ORDINANCE providing for the improvement of: CLAREMONT WAY from 50th Street to 52nd Street by the construction of asphaltic concrete pavement forty (40 ' ) feet in width, by the construction of Portland cement concrete curbs and gutters where they do not presently exist, by the construction of 4" Portland cement concrete sidewalks, where they do not presently exist, by the installation of necessary drainage facilities and making all necessary adjustments, by the construction or reconstruction where necessary of all sewers, side sewers, water mains, and hydrants with necessary appurtenan- ces, by such grading or regrading as may be necessary in con- nection therewith to make a complete improvement, all in accord- ance with plans to be prepared by the City Engineer, and in accordance with Resolution No. 6431 of the City of Everett, creating a Local Improvement District; creating a Local Improve- ment District fund therefor; and providing for the payment of said improvement by special assessments on the property in said district under the mode of payment by bonds . WHEREAS, by Resolution No. 6431 of the City of Everett the City Council has declared its intention to order the improve- ment as above outlined and doing all work in connection therewith to make a complete improvement in accordance with the plans and specifications of the City Engineer of the City of Everett; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1 : That an improvement be made of: CLAREMONT WAY, from 50th Street to 52nd Street by the construction of an asphaltic concrete pavement forty (40' ) feet in width, by the construction of Portland cement concrete curbs and gutters where they do not presently exist, by the construction of 4" Portland cement concrete sidewalks, where they do not presently exist, by the installation of necessary drainage facilities and making all necessary adjustments, by the construction or reconstruction where necessary of all sewers, side sewers, water mains, and hydrants with necessary appurtenan- ces, by such grading or regarding as may be necessary in con- nection therewith to make a complete improvement, all in accord- ance with plans to be prepared by the City Engineer, which plans and specifications are hereby adopted and approved. Section 2 : That the costs and expenses of such improve- ment, including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with the special benefits derived from the improvement without regard to the zone and termini method of spreading assessments . The City shall not be liable in any manner for any of the remaining costs and expenses of the improvement except as provided by Chapter 141, Session Laws of 1923 or acts amendatory thereto and the ordinances of the City of Everett . Section 3: That there is hereby established a Local Improvement District to be known as "Local Improvement District
