• <br /> 1 Grantee judgment shall be rendered against said City in such <br /> suit or action, to satisfy fully said judgment within <br /> 2 ninety (90) days after such suit or action shall have finally <br /> been determined, if determined adversely to the City. <br /> 3 <br /> Section 3 : Before the constructionof the initial <br /> 4 installation and/or replacement of said water line, the <br /> Grantee shall present to the City Engineer of the City of <br /> 5 Everett, complete plans and specification for such installation. <br /> The City Engineer of the City of Everett shall have 30 days <br /> 6 to examine said plans and specifications and to make objections <br /> thereto; all objections shall be in writing and presented to <br /> 7 the Grantee within 30 days of the filing of such plans and <br /> specifications. The Grantee shall be required to comply with <br /> 8 such changes and requests by the City Engineer provided such <br /> demands do not exceed the requirements of the City of Everett <br /> 9 for installation of like improvements in city streets. <br /> 10 Section 4. The Grantee agrees to maintain said water line <br /> at all times; to make reasonable inspection of said water <br /> 11 line, to cause said water line to be in a good state of <br /> repair, to immediately repair said line in case of leakage <br /> 12 of water or other defect, and to immediately repair or replace <br /> all streets, side walks and property damaged by reason of <br /> 13 said water line and/or its condition. <br /> 14 Section 5. In event it shall be necessary for the Grantee <br /> to cause an excavation to be made in any street or side walk, <br /> 15 it shall, prior to making such excavation, except in case of <br /> emergency, notify the City Engineer of the City of Everett <br /> 16 at least five days prior to such excavation. The Grantee <br /> shall post all excavations properly so as to protect users of <br /> 17 the streets and sidewalks. That in event the City Engineer <br /> shall rule that said method of protection taken by the <br /> 18 Grantee is inadequate the Grantee shall upon notice from the <br /> City Engineer, erect such additional reasonable protection as <br /> 19 required. In connection with the making of such excavation, <br /> the Grantee shall make provisions for the movement of <br /> 20 emergency vehicles at all times . <br /> 21 That if at any time the Grantor shall deem it <br /> reasonable and necessary to resurface, realign or change or <br /> 22 improve any street, road, or public place involved herein, <br /> the Grantee will upon notice relocate such water lines and <br /> 23 appurtenances as shall be necessary, all at its own expense <br /> and that in event it is necessary to change, remove or <br /> 24 relocate any public utility belonging to the Grantor <br /> located within such area necessitating the change or <br /> 25 relocation of said water line, the Grantee shall make such <br /> change at its expense. <br /> 26 Should the Grantee fail to make such changes within <br /> 27 a reasonable time after notice, the City of Everett shall <br /> have the right to make such changes and charge the Grantee. <br /> 28 Section 6: Whenever any excavations shall be made <br /> 29 pursuant to the authority herein granted, the Grantee, its <br /> successors or assigns, shall as soon as possible, restore <br /> 30 the portion of the street, alley or public highway excavated' <br /> to the same good order and condition in which it was prior to <br /> 31 such excavating or working, and all said work shall be done <br /> in compliance with the necessary rules, regulations and <br /> 32 ordinances of said City of Everett. <br /> -2- <br />
