1 31, 2023. In the event that Everett chooses to maintain its own comprehensive <br /> 2 solid waste management plan, that plan shall contain nothing in conflict with this <br /> 3 designation of the County System during the term of this Interlocal Agreement. <br /> 4 The designation of the County in this section shall not reduce or otherwise affect <br /> 5 Everett's control over solid waste collection as permitted by applicable state law. <br /> 6 6. Enforcement. The County shall be primarily responsible for <br /> 7 enforcement of laws and regulations requiring persons to dispose of Solid Waste <br /> 8 at sites designated by the County. Everett shall cooperate with the County in its <br /> 9 enforcement efforts, and shall provide, by ordinance, that any person that disposes <br /> 10 of Solid Waste generated within Everett at a site other than a site designated by <br /> 11 the County will be guilty of a misdemeanor, except where such disposal may be <br /> 12 otherwise permitted by state law. To the extent legally possible, the County shall <br /> 13 be responsible for bringing enforcement actions against persons violating state <br /> 14 statutes or County ordinances relating to the disposal of Solid Waste at sites <br /> 15 designated by the County. However, in instances in which the County lacks legal <br /> 16 authority to bring an enforcement action, and Everett possesses that authority, the <br /> 17 County may request that Everett bring such enforcement action. Everett shall <br /> 18 comply with any such request, or exercise its authority under Chapter 35.21 RCW <br /> 19 to ensure, in some other way that Solid Waste generated within Everett is <br /> 20 disposed of at those sites designated by the County. The County shall pay as <br /> 21 System costs all reasonable costs incurred by Everett in taking such enforcement <br /> 22 or other actions that are requested in writing by the County. <br /> 23 <br /> 5 <br /> ILA BETWEEN SNO.CO. &EVERETT <br /> RE:SOLID WASTE MANAGEMENT <br />
