I 411 <br /> PRIVATE DRAINAGE GRANT OF EASEMENT <br /> • <br /> THIS PRIVATE DRAINAGE EASEMENT (the "Agreement") is made this _ day of <br /> , 201_ (the "Effective Date") by and between CLARENCE W & LORAIN G <br /> SORGEN 4913 GLENWOOD AVE, EVERETT, WA 98203 ("Owner"), and ISHA KANJI <br /> DARAMY-BOUDAD,9240 36TH AVE S SEATTLE,WA 98118,(the"Grantee"). <br /> RECITALS <br /> A. Owner owns certain real property commonly known as 4913 Glenwood Ave, Maple Heights, <br /> Everett,WA, as more particularly described on Exhibit A to this Agreement(the"Property"). <br /> B. Owner wishes to grant private drainage easement to pre-existing groundwater drainage system <br /> across Owner's property, relating to repair and reconstruction of a certain retaining wall on <br /> neighboring property, including wall sub-drain reconnection to existing drain system to the <br /> neighboring property owner(the "Grantee"). <br /> C. As a part of reconstruction activity on the adjacent property,project proponent has developed <br /> a site plan (the "Site Plan"), which has been approved by the City of Everett's Department of <br /> Planning & Zoning Services ("P&Z") and is on file in P&Z's records department under File <br /> No. - - <br /> D. The Site Plan depicts the location on the Property and the adjacent property of the project, of <br /> all drainage facilities (collectively, the "Drainage Facilities"), including wall sub-drains, <br /> underground tightlines, catch basins, tie-in to the City of Everett stormwater facilities and all <br /> other structures or facilities that constitute stormwater facilities pursuant to the Snohomish <br /> County Code ("SCC" or the "County Code") and/or the Snohomish County drainage manual <br /> (the "Drainage Manual"), as currently written or as may hereafter be amended. <br /> E. In consideration for the City of Everett's P&Z issuance and approval of the reconstruction <br /> permits and approvals that Grantee requires in order to complete Grantee's reconstruction <br /> activities on the adjacent property, which affects drainage through the Owner's Property, the <br /> Owner now makes certain covenants to the Grantee with respect to the Drainage Facilities and <br /> grants certain easement rights to the Grantee with respect to the Drainage Facilities, all as more <br /> fully described below. <br /> NOW THEREFORE, for good and valuable consideration,the receipt and sufficiency of which <br /> are hereby acknowledged,the parties agree as follows: <br /> Private Drainage Easement Pa <br /> RETAINING WALL RECONSTRUCTION PLAN FOR ISHA DARAMY-BOUDAD Rev.3/30/2016 <br />
