Termination Should Owner or Owner's successor in title to the Property re-develop the Property, as permitted by the County Code and other applicable laws, rules and development regulations, in such a manner that the Drainage Facilities are no longer necessary or useful for their intended purpose,Owner or Owner's successor in title may seek the County's approval to terminate this Agreement. In such event, the County shall agree to terminate this Agreement if termination is permitted by and consistent with the County Code and the Drainage Manual then in effect. To terminate this Agreement,both parties must execute,acknowledge and record a termination agreement. 9. Governing Law; Interpretation This Agreement shall be governed by, and construed in accordance with, the laws of the State of Washington. Venue for any dispute involving this Agreement shall be the Superior Court in and for the County of Snohomish, State of Washington. This Agreement may be amended or otherwise modified only in writing, signed and acknowledged by the party to be charged. If any provision of this Agreement shall be held by a court of competent jurisdiction to be to any extent invalid or unenforceable, the remainder of this Agreement (or the application of such provision to persons or circumstances other than those in respect of which it is invalid or unenforceable) shall not be affected thereby, and each provision of this Agreement, unless specifically conditioned upon such invalid or unenforceable provision, shall be valid and enforceable to the fullest extent permitted by law.
