Termination <br /> Should Owner or Owner's successor in title to the Property re-develop the Property, as <br /> permitted by the County Code and other applicable laws, rules and development regulations, <br /> in such a manner that the Drainage Facilities are no longer necessary or useful for their intended <br /> purpose,Owner or Owner's successor in title may seek the County's approval to terminate this <br /> Agreement. In such event, the County shall agree to terminate this Agreement if termination <br /> is permitted by and consistent with the County Code and the Drainage Manual then in effect. <br /> To terminate this Agreement,both parties must execute,acknowledge and record a termination <br /> agreement. <br /> 9. Governing Law; Interpretation <br /> This Agreement shall be governed by, and construed in accordance with, the laws of the State <br /> of Washington. Venue for any dispute involving this Agreement shall be the Superior Court in <br /> and for the County of Snohomish, State of Washington. This Agreement may be amended or <br /> otherwise modified only in writing, signed and acknowledged by the party to be charged. If <br /> any provision of this Agreement shall be held by a court of competent jurisdiction to be to any <br /> extent invalid or unenforceable, the remainder of this Agreement (or the application of such <br /> provision to persons or circumstances other than those in respect of which it is invalid or <br /> unenforceable) shall not be affected thereby, and each provision of this Agreement, unless <br /> specifically conditioned upon such invalid or unenforceable provision, shall be valid and <br /> enforceable to the fullest extent permitted by law. <br /> Signed and delivered on the day and year first above written. <br /> OWNER <br /> By <br /> Name: ' a�.
