• • <br /> • An additional garage was constructed under the deck on the SE corner of the house and has not <br /> been approved. <br /> • The adjacent grounds to the entry porch area were not built to the approved plans. Steps and <br /> guards are required and the retaining wall supporting the entry patio has not been inspected or <br /> approved. <br /> • The dwelling unit does not have a certificate of occupancy; permits for the structure have <br /> expired. <br /> Both the wall and dwelling have been before the Hearing Examiner in the past and are still not in <br /> satisfactory condition. The dwelling should remain unoccupied and "Unlawful" until a Certificate of <br /> Occupancy is issued. Further,the ecology block retaining wall structure is"Dangerous" per IPMC <br /> Section 108.1.5, Item 5 based on the following: <br /> "The building or structure, or part of the building or structure, because of dilapidation, deterioration, <br /> decay,faulty construction,the removal or movement of some portion of the ground necessary for the <br /> support, or for any other reason, is likely to partially or completely collapse, or some portion of the <br /> foundation or underpinning of the building or structure is likely to fail or give way." <br /> The owner should be directed to rebuild the wall in a safe manner as prescribed by code. Permits are <br /> required to be obtained for the wall and dwelling.
